Overview

These Terms of Use ("Terms") govern your access to and use of the Pucky mobile application (the "App"), operated by EmeraldApps ("we," "us," or "our").

By using Pucky, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

1. Apple's Standard License Agreement

Pucky is distributed through the Apple App Store and is subject to Apple's Licensed Application End User License Agreement (EULA).

In summary, Apple's EULA covers:

• Your license to use the App (non-transferable, non-exclusive, personal use only)
• Restrictions on modifying, reverse-engineering, or redistributing the App
• Apple's role as a third-party beneficiary (not the seller)
• Compliance with App Store Review Guidelines and export restrictions

2. Additional Pucky-Specific Terms

In addition to Apple's standard terms, the following apply to your use of Pucky:

2.1 Ownership of Your Content

You retain all rights to the content you create in Pucky, including:

• Shot logs (tasting notes, ratings, extraction parameters)
• Equipment details and custom names
• Photos you upload
• Any other user-generated content

We do not claim ownership of your content. However, by using the App, you grant us a limited license to:

• Store your content in our Firebase databases
• Process your content to provide AI-powered features (shot suggestions, maintenance guides, bean identification)
• Display your content back to you within the App

This license ends when you delete your content or account.

2.2 AI-Generated Content

Pucky uses Google's Gemini AI to generate:

• Personalized shot improvement suggestions
• Machine-specific maintenance instructions
• Coffee bean identification results

Important Disclaimers:

• AI-generated content is provided "as-is" for informational purposes only
• AI suggestions are NOT professional advice
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• You are responsible for deciding whether to follow AI suggestions
• EmeraldApps is not liable for any damage to equipment or poor-tasting espresso resulting from following AI recommendations

Use common sense. If an AI suggestion seems incorrect or unsafe (e.g., "set your machine to 500°F"), do not follow it.

2.3 Subscriptions & In-App Purchases

Pucky offers an optional Pro subscription with additional features.

Subscription Terms:

• Subscriptions are billed through your Apple ID and managed in your App Store account settings
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• You can cancel anytime via Settings → [Your Name] → Subscriptions in iOS
• Refunds are handled by Apple, not EmeraldApps — see Apple's refund policy
• If you delete your account, you will lose access to Pro features even if your subscription is still active (no refund)
• Family Sharing: Subscriptions may be shareable with Family Sharing (subject to Apple's policies)

What happens to your data if your subscription lapses:

• Free users can still access all their existing shot logs, equipment, and beans
• Pro features (AI coaching, unlimited equipment, advanced analytics) will be disabled until you re-subscribe
• Your data is NOT deleted when your subscription expires

2.4 Prohibited Uses

You may NOT use Pucky to:

• Upload illegal, harmful, or offensive content (we reserve the right to remove such content)
• Attempt to hack, reverse-engineer, or extract source code from the App
• Use the App to compete with or harm EmeraldApps
• Abuse AI features (e.g., spamming the AI with requests to cause server load)
• Violate any applicable laws or regulations

2.5 Service Availability

We strive to keep Pucky available 24/7, but we do not guarantee:

• Uninterrupted access to the App or cloud sync features
• Error-free operation
• Availability of AI features (which depend on Google's Gemini API)

We may temporarily suspend the App for maintenance or updates. We are not liable for downtime or data loss.

2.6 Data Backup

You are responsible for backing up your data. While we store your data in Firestore, we recommend:

• Periodically exporting your shot logs (feature not yet available, but planned)
• Taking screenshots of important equipment settings
• Not relying on Pucky as your only record of critical information

We are not liable for data loss due to:

• Account deletion (by you or us)
• Firebase service outages
• App bugs or crashes
• Device loss or failure

3. Account Termination

3.1 Termination by You

You can delete your account at any time via Settings → Account → Delete Account.

Deleting your account:

• Permanently erases all your shot logs, equipment, photos, and user profile
• Cannot be undone
• Does NOT automatically cancel active subscriptions (you must cancel separately via App Store)

3.2 Termination by Us

We may suspend or terminate your account if you:

• Violate these Terms
• Abuse AI features or engage in fraudulent activity
• Upload illegal or harmful content

We will notify you via email (if provided) before termination unless doing so would violate the law or prevent harm.

4. Disclaimers & Limitation of Liability

4.1 "As-Is" Service

Pucky is provided "as-is" and "as available" without warranties of any kind, express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy or reliability of AI suggestions
• Uninterrupted or error-free operation
• Security against unauthorized access

4.2 No Liability for Equipment Damage

Using Pucky does NOT replace reading your espresso machine's manual or following manufacturer guidelines.

We are not liable for:

• Damage to your equipment from following AI maintenance suggestions
• Injury from improper machine use
• Voided warranties from incorrect maintenance
• Poor-tasting espresso (sorry!)

4.3 Limitation of Liability

To the maximum extent permitted by law:

• EmeraldApps is not liable for any indirect, incidental, or consequential damages arising from your use of Pucky
• Our total liability to you is limited to the amount you paid for the App in the 12 months prior to the claim (i.e., your subscription fees, if any)

Some jurisdictions do not allow limitations on implied warranties or exclusions of liability, so these limitations may not apply to you.

5. Governing Law

These Terms are governed by the laws of [Your Jurisdiction — e.g., State of California, United States], without regard to conflict of law principles.

Any disputes arising from these Terms or the App will be resolved in the courts of [Your Jurisdiction].

6. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via an in-app message or email (if you provided one)

Continued use of the App after changes constitutes acceptance of the updated Terms.
